Rullamas said Diaz had just exited the van's side door when Tatum - who police think was a lookout for the others - confronted him at gunpoint, shoved him back inside and demanded money. Diaz was shot without warning. and Tatum ran along 38th Avenue toward the Fruitvale BART station.

Witnesses provided a description to police, whothen saw Tatum walking in the 3900 block of San Leandro Street. He tried to run away but was caught and arrested.

He later pointed out to police a location on a map where he said he discarded the gun. But police searched the area and could not find it, Rullamas said.

Rullamas said Diaz and his girlfriend had been dating about four months. He said Diaz came to the United States from Mexico City, where his children and his mother still live.
